City of Upper Arlington Social Media Comment and Terms of Use Policy

By posting material on social media sites, the City of Upper Arlington does not, and does not intend to, create a traditional public forum. The City’s social media accounts, profiles, posts, comments, and threads are maintained for purposes of the City’s expressive conduct, are closely identified in the public mind with the City, and therefore constitute government speech. Comments containing any of the following inappropriate content will not be permitted on the City’s social media sites and are subject to removal or restriction by the Social Media Administrator or his/her designees:

  1. Comments not on-topic to the particular subject being discussed by the City;
  2. The promotion or endorsement of a political campaign or candidate;
  3. Obscene, profane, sexual, or pornographic language or content;
  4. Threats to any person;
  5. Content that promotes, fosters, or perpetuates discrimination on the basis of race, creed, color, age, religion, gender, marital status, national origin, status with regard to public assistance, physical or mental disability, gender identity or sexual orientation;
  6. Solicitations or promotions of specific commercial services, products, or entities;
  7. Content that violates or appears to violate a legal property right of the City or a third party under federal or state law, such as copyright or trademark;
  8. Conduct that violates any federal, state, or local law, or promotes or encourages illegal activities;
  9. Information that compromises the safety or security of the public or public systems;
  10. Personal identifiable information or sensitive personal information that if released violates federal or state law;
  11. Information that directly interferes with or compromises ongoing investigations, public safety tactics, or the safety of public safety officers;
  12. Confidential or exempt information in violation of state or federal law;
  13. Spam or links to malware/viruses;
  14. Links to any site or content posted by automatic software programs (i.e. “bots”); or
  15. Content that violates federal, state or local law.

A comment posted by a member of the public on any City social media site is the opinion of the poster only, and publication of a comment does not imply endorsement of, or agreement by, the City, nor do the comments necessarily reflect the opinions or policies of the City.

The City also reserves the right to block or otherwise deny access to City social media sites for any individual or users who violate the City’s social media policy, at any time and without prior notice.

All comments posted to the City’s social media sites are bound by that platform’s terms of use and the City reserves the right to report any violations to the social media platform with the intent of it taking appropriate and reasonable responsive action.

Requests for emergency services should be directed to 9-1-1 and not through any of the City’s social media sites.

Users who enter private or personal information on Government social media do so at their own risk, and the Government is not responsible for any damages resulting from the public display of, or failure to remove, private or personal information.

This policy and terms of use may be amended from time-to-time and without further notice.
